Under Australian Consumer Law, automatic consumer guarantees apply to any Titan product or services you buy, regardless of the warranty period specified for individual products. In addition to Australian Consumer Law guarantees, Titan Sinkware offers a manufacturer’s warranty on all products. Automatic Consumer Guarantee

 

Since 1 January 2011, the following consumer guarantees on products and services apply.

All Products must be of acceptable quality and meet the following criteria:

  • All products must be safe, long-lasting, and have no faults.
  • All products must look acceptable.
  • All products must do everything someone would normally expect them to do.


Acceptable quality takes into account what one would normally expect for the type of product and cost.

All Products must meet the following criteria:

  • All products must match the descriptions made by the salesperson, made on the packaging and labels, and made in promotions or advertising.
  • All products must match any demonstration model or sample you asked for.
  • All products must be fit for the purpose the business told you it would be fit for and for any purpose that you made known to the business before purchasing.
  • All products must come with full title and ownership.
  • All products must not carry any hidden debts or extra charges.
  • All products must come with undisturbed possession, so no one has a right to take the goods away or prevent you from using them.
  • All products must meet any extra promises made about performance, condition, and quality, such as lifetime guarantees and money-back offers.
  • All products must have spare parts and repair facilities available for a reasonable time after purchase unless you were told otherwise.

 

Lifetime Warranty Against Defects - Sinks

 

Titan Sinkware Pty Ltd offers a lifetime warranty against defects. This is also called a manufacturer’s warranty. This is a representation to a consumer, made at or around the time that goods are supplied, that if the goods (or part of them) are defective, Titan Sinkware will do the following:

  • Titan Sinkware will repair or replace goods (or part of them).
  • Titan Sinkware will resupply or fix a problem with services (or part of them).
  • Titan Sinkware will provide compensation to the consumer.


A warranty against defects is usually limited by time. All suppliers, manufacturers and service providers that provide you with a warranty against defects must comply with that warranty. If they do not, you may bring an action against the person or business who provided the warranty, either under the ACL or for breach of contract. A promise about what the supplier or manufacturer will do if something goes wrong can be a warranty against defects even if it is not provided in a formal document. Any material with writing on it could evidence a warranty against defects, for example wording on the packaging or on a label, if those words contain such a promise. A warranty against defects is provided in addition to the consumer guarantees and does not limit or replace them.

 

Warranty Against Defects - Tapware

 

Titan Sinkware Pty Ltd offers warranty against defects for 10 Years: 5 years on parts and labour plus an additional 5 years on the cartridge (parts only), when used in a domestic situation. This is a representation to a consumer, made at or around the time that goods are supplied, that if the goods (or part of them) are defective, Titan Sinkware will do the following:

  • Titan Sinkware will repair or replace goods (or part of them).
  • Titan Sinkware will resupply or fix a problem with services (or part of them).
  • Titan Sinkware will provide compensation to the consumer.

Claim Entitlements

 

You can claim a remedy from Titan Sinkware if the products do not meet any one or more of the consumer guarantees, with the exception of availability of spare parts and repair facilities. The remedies you can seek from Titan Sinkware include a repair, replacement, or refund and, in some cases, compensation for damages and loss. You can claim a remedy directly from Titan Sinkware if the goods do not meet one or more of the following consumer guarantees:

  • The products are not of acceptable quality.
  • The products do not match the description.
  • The products do not meet any extra promises made about the product, regarding things such as performance, condition, and quality.
  • Repair facilities and spare parts are not available. The manufacturer is responsible for ensuring that spare parts and repair facilities (a place that can fix the consumer’s goods) are available for a reasonable time after purchase.

 

You are only entitled to recover costs from Titan Sinkware, which includes an amount for the reduction of the product’s value and, in some cases, compensation for damages or loss.

 

Exceptions to Guarantees & Warranty

 

Consumer guarantees do not apply for the following reasons:

  • If you received the correct order but simply changed your mind, found it cheaper somewhere else, decided you did not like the purchase, or had no use for it.
  • If you misused a product in any way that caused the problem.
  • If you knew of or were made aware of the faults before you bought the product.
  • If you asked for a service to be done in a certain way against the advice of the business or were unclear about what you wanted.

    The Titan warranty does not apply for the following reasons:

    • Scratches to the product’s surface
    • Normal wear and tear
    • Improper installation

       

      Where a warranty exists or is implied by law, Titan Sinkware’s liability is limited (to the extent that it can be limited) to repair or replacement of the faulty replaceable element, the unit, or an equivalent unit. Titan Sinkware may, at its discretion, choose whether it shall repair or replace any unit or replaceable element. Titan Sinkware may also choose to pay the cost of replacing the replaceable element or the unit or pay the cost of having the unit repaired. To the extent permitted by law, Titan Sinkware assumes no liability whatsoever and disclaims all liability for direct, indirect or consequential loss, or special, general or other damage or expense caused by or arising out of the following:

      • Any failure to install or use the unit in accordance with the manufacturer’s instructions, the installation and operating manual, or Titan Sinkware’s printed instructions.
      • The purpose for which you are purchasing the unit.

       

      You acknowledge that the quality of water supplied and your water usage rate and influent water pressure may vary seasonally or over a period of time. In addition, water characteristics can differ if the unit is relocated or the environment changes. You acknowledge that Titan Sinkware does not know your requirements and cannot and does not warrant that the unit is fit for the purpose for which you intend to use the unit or is appropriate for the purpose for which you intend to use the unit. Titan Sinkware does not authorize others to assume any obligation on its behalf even if you inform them of the purpose for which you intend to use this unit.

       

      Tapware Service Details

       

      If the tapware problem represents any danger or potential to damage property, immediately shut off the water supply. If the mixer tap requires servicing, please contact your plumber (preferably the one who installed it). Most problems occur due to contaminated supply lines or water pressure exceeding 600kPa. If the plumber is satisfied that the problem is not due to poor installation, then make a warranty claim.

      If a warranty service call finds that the mixer tap is not at fault or an installation fault is present, Titan Sinkware Pty Ltd reserves the right to pass on any callout fee to the householder.

      • Invoice number
      • Product model number
      • Date of purchase
      • Proof of purchase
      • A copy of a certificate which certifies that the unit was installed in compliance with our printed installation instructions and all applicable laws, regulations and industry standards

         

        Titan Sinkware will only pay for repair or replacement upon receipt of proof of your purchase showing the date of purchase. Please allow 1–2 business days after lodging your claim for our customer service team to contact you.
